Santiago, July 1, 2026 - Codelco welcomed the resolution adopted today by the Rancagua Guarantee Court, which granted the protection of guarantees requested by the Corporation, and reaffirmed that the investigation must be rational and respectful of the rights that the law recognizes for all parties involved.

In its ruling, the court declared that Codelco's right to legal counsel had been violated and limited the scope of the prosecution's information requests. The court also reiterated that the investigation must remain focused on clarifying the facts at issue in the case and not on reconstructing the entirety of the historical activity carried out by the El Teniente Division. The 27 new information requests challenged by Codelco had sought information on all units of the mine since its inception in 1905.

The resolution confirmed, among other aspects, Codelco's right to participate with its defense in the corresponding proceedings; it specified that it is not appropriate to require the accused to prepare or process information to respond to requests when this may affect its procedural guarantees; it recognized the company's right to provide information when certain background information does not exist and to raise the reservations that the law contemplates regarding strategic or protected information.

Codelco argued before the Court that the investigation must be carried out with respect for the rights of the accused and concentrate efforts without deviating from the essential: to move effectively towards clarifying the facts under investigation.

“Codelco has cooperated from the very beginning. Our first priority is the families of the victims, and with the families of the victims in mind, we want a fair investigation, a rational investigation, and therefore a much faster one,” said the corporation's lawyer, Davor Harasic.

Since the accident at the El Teniente Division, the Corporation has actively collaborated with the Public Prosecutor's Office, responding to 30 requests for information, providing more than 14,000 background documents, facilitating its own technical investigations and providing specialized support to multiple investigative procedures.

The Corporation reiterated its respect for the work of the Public Prosecutor's Office and for the decisions made by the courts, and especially for the families of the victims. Therefore, the company will continue to actively cooperate with the investigation and provide all relevant information to contribute to a full clarification of the facts.
