Public statement from Codelco regarding the admissibility of the lawsuit against former minister Ángela Vivanco

Codelco values the resolution issued today by the Santiago Court of Appeals, which accepted the complaint of chapters against the former Supreme Court Minister, Ángela Vivanco, allowing the criminal investigation to continue in accordance with the law, and which confirms the solidity of our arguments and the robustness of the evidence that together with the Public Prosecutor's Office we have presented in different instances and hearings of the process.

As a state-owned company and an affected party, Codelco has suffered significant damage to its assets, exceeding $17 billion, and consequently, to the assets of all Chileans. The lawsuit alleges repeated and irregular actions, which the ruling describes as serious and consistent evidence, suggesting that former Supreme Court Justice Ángela Vivanco intervened at various stages of the process, including the unusual acceleration of resolutions and decisions that benefited the Belaz Movitec Consortium.

Since the irregularities were detected in 2023, the Corporation has acted diligently and proactively. After the state-owned company was recognized as a victim in the investigation opened ex officio by the National Prosecutor in September 2024, the company has actively cooperated, providing all available information, requesting investigative measures that generated important lines of inquiry, appearing at every stage, exercising the corresponding legal actions, and actively collaborating with the Prosecutor's Office and the competent institutions to contribute to the full clarification of the facts.

Our participation stems from an unavoidable institutional duty: to safeguard public resources, defend the public interest, and contribute to ensuring that any potential liabilities are determined and sanctioned in accordance with the law. Codelco will continue to cooperate with this investigation, reaffirming its commitment to public ethics and transparency.
